Bluefield Regional Medical Center Awarded Summary Judgment in Federal Court

Judge David A. Faber,  Senior United States District Judge of the Southern District of West Virginia, recently granted Bluefield Regional Medical Center’s (“BRMC”) Motion for Summary Judgment in a medical professional liability case, dismissing the plaintiff’s (remaining) claim against BRMC with prejudice. Judge Faber agreed with BRMC’s argument that the plaintiff did not make a prima facie case of medical malpractice under the MPLA, as the plaintiff presented no expert testimony that the hospital’s alleged breach in the standard of care was a proximate cause of the patient’s injury or death. Plaintiff’s entire case against BRMC was therefore dismissed with prejudice.
