Motion for Summary Judgment Granted in Civil Rights Case Brought Against Dunbar Police Officer

Mark McGhee and Tim Mayo obtained a dismissal of all claims against a Dunbar Police Officer on June 12, 2023. The officer was sued for alleged civil rights violations related to a search of a home in Dunbar. The Plaintiffs claimed that their 4th Amendment rights were violated. In addition to dismissing the civil rights claim, Judge Irene Berger dismissed the Plaintiffs’ cause of action for intentional infliction of emotional distress. The case is pending before the U.S. District Court for the Southern District of West Virginia. Judge Berger granted the motion for summary judgment based on a legal ruling that probable cause existed for the search and that officer did not violate the Plaintiffs’ constitutional rights.
