Motion to Dismiss Granted in Case Involving Four Parkersburg Police Officers

Mark McGhee and Tim Mayo obtained a dismissal of all claims against four Parkersburg police officers on May 11, 2023. The officers were sued for alleged civil rights violations related to their work after reporting to the scene of a fight. Plaintiff claimed that his 1st and 14th Amendment rights were violated when criminal charges were not brought against the men who were alleged to have injured him in the fight. The case is pending before the U.S. District Court for the Southern District of West Virginia. Judge Irene Berger granted the motion to dismiss based on a legal ruling that Plaintiff had not sufficiently alleged facts to prove the officers violated his constitutional rights.
